Order no.  1,  dt. 14.12.2024.

This case record has been placed before the ld. Judges of National Lok Adalat which is held on this day at the court room of D.C.D.R.C., Hooghly.

Both parties are found present and ready with ld. Lawyers.

In course of hearing the complainant/ petitioner pointed out that they already have paid the balance consideration amount to the op promoter/ developer who received the said amount. It is also pointed out by the complainant/ petitioner that the ops promoter/ developers and land owners already have handed over the possession to flat no. 403 of Block D, Manoka Apartment situated at premises no. 9, Bazar lane, P.O. & P.S. Uttarpara, Dist Hooghly and possession letter has also been handed over to the applicant. The representative of the ops, Debasish Modak who is the op no. 2 is found present and admitted that point of contention which have highlighted by the complainant/ petitioner. In course of hearing the petitioner/ complainant also pointed out that she already have paid the balance consideration amount of Rs. 3, 50,000/- to the op promoter/ developer. This fact is also admitted by the ops promoter/ developer.

From the point of contention highlighted by the complainant and ops and their ld. Lawyers, ld. Judges are of the view that the disputes involved in this case have been amicably settled and parties are also ready and willing to execute and register the deed of conveyance within 1 year.

As the disputes involved in this case have amicably settled in between the parties, this District Commission has no reason to stand on the way in the matter of settlement.

In the result it is accordingly

ordered

that the complaint case being no. 97 of 2024 be and the same is disposed of as it is settled between the parties.

Both parties (complainant and ops) are directed to execute and register the deed of conveyance within 1 year from the date of passing of this judgement. Otherwise the complainant is given liberty to execute this award as per law.

Let a free certified copy of this order be handed over to the parties immediately.
