The Complainant is by profession a Doctor working with RML Hospital on very senior position availed services of OP1 on behalf of OP2 to set up Dish TV at his residence. Complainant paid Rs.2,290/- through Net Banking to OP to install Dish TV within 24 hours but OP1 failed to provide such facilities. Consequently complainant desperately approached OP2 many times. Ultimately OP installed Dish TV with further cost Rs.2,73/- vide receipt 23950 dated 09.11.12 but it was not activated despite several reminds. Thus complaint was filed for unlawful act of OP with respected professional, which created unwanted mental tension as well as harassment.
OP2 in his reply admitted regarding payment of Rs.2,290/- on 09.11.12 in Para8-10 and alleged that OP2 would need to visit complainant residence to find out exact issue but OP never visited despite several requests. Further OP also admitted complainant’s legal notice. It is also noticed that OP deliberately did not activate the connection consequently a dignified professional was compelled to enter into litigation to spend money from his own pocket.
OP in its letter dated 01.03.13 agrees to refund the money. Scrutiny of record reveals that complaint was filed on 18.01.13 and offer of refund was made only after the complaint was made in the Forum.
As per evidence of complainant Para5 that OP had allotted a token number bearing 2301417 to the complainant i.e. confirmation assurance to install Dish TV by OP2 on behalf of OP1 but OP2 failed to install Dish TV at Complainant’s Govt. accommodation despite several visits and reminders telephonically which clearly appears that OP is deficient and adopted unfair trade practices to collect money from various consumers on the plea of Dish TV, which is mount to be criminal offence.
Keeping in view, OP1 and OP2 is jointly directed to refund Rs.2,290/- plus Rs.2,73/- along with 9% interest from the date of deposit till payment. We also award compensation of Rs.5,000/- for deficiency, harassment and Rs.5,000/- for litigation expenses.
The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25/27 of the Consumer Protection Act.

Copy of the order be sent to the parties free of cost.
