Present: Complainant in person and counsel for OP Shri Rohit Bavecha.
OP failed to settle the matter or file the WS. Arguments heard at length.
Complainant booked a travel package with OP for 4 star tour packages for Malaysia for taking his wife on honeymoon trip immediately after wedding. However, on reaching Malaysia, complaint was placed in 3 star hotel. Food and services were unsatisfactory.
OP counsel though not filing WS made oral submission stating that a typographical mistake was made and 4 stars was erroneously typed instead of 3 star.
We have considered the argument, pleadings and correspondence between the parties. After several correspondence, in email dated 19.3.2013, OP agreed to refund Rs.12,000/-.
A person taking a first trip after marriage put in his best effort and maximum resource to make it a life time experience. OP had in their email dated 20.12.2013 promised them an unparallel experience and given detailed itinerary in which hotel name was given as LE SURCAUF 4 star. The complainant duly paid for the package. On reaching his destination, he was shocked to find the Hotel as 3 star (brochure of hotel annexed with complaint) and severely lacking in services promised. The whole honeymoon trip of complainant was spoiled despite his paying full amount in advance. OP is trying to wriggle out of his commitments towards complainant by stating 4 star as typographical error. OPs contention being devoid of merit, must fail and same stands rejected.
We, therefore, hold OP guilty of deficiency in providing the facilities promised and indulging in unfair trade practice. We direct OP to pay Rs.50,000/- as compensation for negligence, deceptive trade practice, harassment and Rs.10,000/- as litigation expenses.
The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

Copy of the order be sent to the parties free of cost.
