ORDER

During the course of arguments, our attention is drawn to the order of the Hon’ble President dated 5th September, 2014 whereby an earlier transfer application moved on behalf of Tamilnadu State Consumer Disputes Redressal Commission at Chennai, was disposed of. Since an earlier application for transfer has already been dealt with by Hon’ble President of this Commission, we refrain from passing any order on this transfer application of the petitioner and matter be put up before Hon’ble President for further directions.

 Matter be listed today at 2.00 pm on request of the petitioner.

 

Matter is again assigned to us by Hon’ble President.

Heard.  Vide this transfer application, the applicant has sought transfer of his Appeal No.17 of 2015 pending before the State Consumer Disputes Redressal Commission, Chennai to State Consumer Disputes Redressal Commission, Delhi on the grounds mentioned in the application.

This matter was assigned to us by the Hon’ble President in the morning.  We observe that an earlier application no.3 of 2014 which was filed before this Commission had been dealt with by the Hon’ble President whereby the transfer application was dismissed.

This matter has been again assigned to us to deal with.  Without expressing any opinion on the contents of the transfer application, in view of the fact that the State Commission had earlier sought transfer of this matter and the applicant wants it, we hereby transfer all the appeals arising of the impugned order of the District Forum dated 14.02.2014 to State Consumer Disputes Redressal Commission, Delhi.  It is brought to our notice that there are three appeals being Appeal no.17 of 2015 filed by the applicant and appeal no.352 of 2014 and 353 of 2014 filed by the respondent.  With these observations, all these three appeals are therefore transferred to the State Commission, Delhi.

Transfer application stands disposed of in above terms.
