This order is arising out of M.A being No. 63/2018 filed by the O.P. No.1, O.P. No.1/1, and O.P. No. 1/II in the C.C. No. 358/2017 praying for counter claim of Rs. 3,00,000/- for mental pain and agony along with damaging the repudiation of business of the O.Ps. The said O.Ps have also prayed for litigation cost of Rs. 30,000/-.

In the application it is stated by the complainant that for purchasing a flat the complainant paid the consideration amount and entered into agreement with the O.Ps, but subsequently the complainant has failed to comply with the terms and conditions of the said agreement. Without compliance with the terms and conditions the complainant has filed this

complaint in ulterior motive with a view to a grasp money from this Ld. Forum through an unscrupulous manner. According to the said O.Ps if this application is not allowed they will suffer irreparable loss and injury and accordingly prayer is made by the O.Ps for allowing this application. Upon receipt of the copy of this application the Ld. Counsel for the complainant has raised vehement objection stating that such type of application cannot be maintainable before the Consumer Forum as this Forum being the Consumer Forum, is not a Forum wherein the service provider can also file any application claiming damages from the complainant. The Ld. Counsel for the complainant has also stated that if there is any grievance of the O.Ps against the complainant, other Forum/ Court has already been established under the Concerned Act wherein the O.Ps can ventilate their grievances. According to the complainant, this application is liable to be dismissed being motivated one.

Upon considering the content of the application as filed by the O.Ps and hearing the objection as stated by the Ld. Counsel of the complainant, we are of the view that the C.P. Act was enacted in 1986 with a view to provide better protection to the interest of consumers from the unscrupulous service provider. This Consumer Forum has not been established to save guard the interest of service provider. Admittedly, the service provider must have grievance against the consumer, but the Consumer Forum is not the right Forum to ventilate the same as the C.P. Act does not provide us any power to pass any order in favour of the service provider wherein the service provider is claiming damages and litigation cost against the complainant.

Going by the foregoing discussion,

Hence,

                         it is ordered

                                               that the M.A. being No. 63/2018 is hereby dismissed on contest without any cost.

Let a plain copy be given to the parties free of cost as per CPR, 2005.
