This order is arising out of the M.A being No. 04/2019 filed by the Jdr Nos. 1,2 and 3 in the E.A. No. 154/2013 praying for exemption from making payment of the punitive damage by the said Jdrs as per the order under execution. It is seen by us that already the said Jdrs have paid sum of Rs. 35,000/- towards the punitive damage to the SCWF. Therefore, question to waive the balance punitive damage does not arise at all. Moreover, sitting in the Executing Court we cannot go beyond the decree and moreover having no power either to review or recall our own order, we are not in a position to allow the prayer of the Jdrs. Hence the prayer of the Jdrs should be dismissed.
