Complainant side is found present and ready.

Heard ld. advocate for the complainant side.  Considered submission.

In course of hearing the complainant side has given emphasis on the documents which have been annexed alongwith the complaint petition.

On the background of the above noted position this District Commission after going through the material of this case record finds that the complainant is not at all a consumer under the Ops.  Moreso the allegations which have been described in the complaint petition is highlighting that the offence of fraud has been practised upon the complainant.  But fact remains that for the purpose of getting relief in respect of the offence of fraud the complainant has the liberty of approaching before the criminal court.  In this regard it is important to note that this District Commission has no scope of determine the issue as to whether the offence of fraud has been practised upon the complainant in a summary trial procedure.

Considering all the above noted factors this District Commission finds that this is not a fit case for admission.

As a result of which this complaint case is not admitted and it is dismissed.

No order is passed as to cost.
