MR. UTPAL KUMAR BHATTACHARYA, HON’BLE MEMBER.

          Misc. Application bearing Nos. MA/727/2015, MA/755/2015 and MA/884/2016 arising out CC/238/2015 were taken up for passing order.

          In MA/727/2015, Complainant has prayed for an order for appointment of a Commissioner for holding local inspection of the property scheduled therein.

          In MA/755/2015, the Complainant has prayed for passing an order for

  1. Dismissing the Complaint Case being No. CC/238/2015.
  2. Granting of stay of further proceeding in or connecting with CC/238/2015.
  3. Vacating the order dated 7th July, 2015 passed by the Learned Commissioner.
  4. Granting stay of operation of the order dated 7th July, 2015 till the disposal of the Misc. Application.

In MA/884/2016,  being the last of the three MAs, the Complainant prayed for an order permitting withdrawal of the complaint case as the disputes and differences between the parties were amicably settled and also prayed for dismissing the complaint for non-prosecution.

          Heard the Ld. Advocates appearing on behalf of both sides who admitted the fact that the disputes and differences between the parties have been amicably settled and prayed for the case to be dismissed for non-prosecution.

          The prayer in MA/884/2016, in view of the above, is allowed.  The complaint is, therefore, disposed of as withdrawn.    Consequently, since the MA/727/2015 and MA/755/2015 have lost its relevance and significance, the said two Misc. Applications are also disposed of.
