The complaint pertains to deficiency in service in regard to holiday packages. The complainant purchased two holiday package from OP-1 and amount was credited to OP-1 on 4.9.2012. Credit Card statement annexed with the evidence. To his surprises, he received holiday vouchers from OP-2 & OP-3. None-the-less, he made a request for booking hotels in Simla. He received an email dated 28.11.12 which stated that complainant is required to provide two different date and destination with an advance notice of 30-90 days. Complainant made repeated requests which was turned down under one pretext or other. Notice was issued to OPs but none appeared. OP were proceeded ex-parte on 1.7.2013.
The fact in the case speaks for itself. Correspondence reveals that OPs did not honor their commitment of providing the accommodation promised in their holiday voucher.
OP-1 by accepting the payment and subsequently using a second and third party to provide holiday package with new terms and conditions have indulged in ethically questionable business practices.
We, therefore, find OP is guilty of unfair trade practices and direct it to pay Rs.11,996/- with 12% interest from date of payment till realization. We award Rs.15,000/- as compensation for harassment and Rs.15,000/- for litigation expenses.
Order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action will be taken under Section 25 / 27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
