ORDER

1.       This revision petition has been filed under Section 21(b) of the Act 1986 in challenge to the Order dated 01.02.2008 of the State Commission in appeal no. 560 & 597 of 2007 arising out of the Order dated 18.05.2007 of the District Commission in complaint no. 600 of 2005.

2.       The learned senior counsel for the respondent no. 1 and 2 (M/s. Kuoni Travel (India) Pvt. Ltd. and its managing director) submits on instructions that the said respondents wish to settle the matter by paying an amount of Rs.2.50 lakh (Rupees two lakh fifty thousand only) to the petitioner no.1 (Shri Rakesh Jain) to settle the matter.

3.       The learned counsel for the petitioners (Shri Rakesh Jain, the complainant no. 1 and Smt. Anupam Jain, the complainant no.2) submits on instructions that provided the said amount of Rs.2.50 lakh duly paid within two weeks from today, the complainants will not further agitate their petition.

4.       In the wake of the above submission there appears to be no further need to go into the merits of the case.  The instant revision petition no. 1369 of 2008 is disposed of with the following directions:

The respondent no.1 and 2 shall pay a sum of Rs.2.50 lacs (Rupees two lac fifty thousand only) to the complainant no.1 within two weeks from today.

5.         The Registry is requested to send a copy each of this Order to the parties in the petition and to their learned counsel within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
