The complainant purchased a Videocon Mobile worth Rs.2,500/- vide bill on record from OP1 dealer. The mobile developed some defects within warranty, which was set right by charging Rs.2,50/- by OP2. It again became defective and complaint was filed, making Videocon OP3 as party, which exparte.
In the face of exparte evidence of bill and service centre receipt for repair, we hold OP3 liable for marketing a defective mobile and award a compensation of Rs.5,000/- inclusive of litigation expenses against OP3.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
