The complainant on internet booked a ticket of flight from Patna to Kolkata for 02.05.10, through OP2. The complainant on reaching Airport found the flight cancelled. He cancelled the ticket which OP2 returned in Court, when summoned. OP1 contested the claim. It admitted cancellation, but due to operational reasons, not shared with Forum, and stated that complainant was informed by SMS but he could not be contacted by mobile, being switched off. These facts are denied by complainant. He purchased another ticket at a high cost of Rs.3,008/-.

We have considered the entire matter, and find that there is no satisfactory evidence of complainant being informed in time; otherwise he would not have come to airport. Keeping in view, all circumstances, and delay in refund, we direct OP1 to pay Rs.2,000/- for inconvenience to complainant and OP2 to pay Rs.5,000/- for litigation expenses, for refund the fare in Court, rather than earlier itself. This includes cost difference of higher ticket cost.

The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
