The case of the complainant is that his minor son aged 15 years had a confirmed ticket of OP airlines for travel from Delhi to London on flight no.1T002, on 15.05.10. He had all valid documents of travel with him. Yet the officials of OP, at the airport denied him boarding. The child was alone at airport, with no support and the anxious parents were worried and requested the relative to again come back to airport to stay with the child. The complainant also booked a ticket for himself to rush from England to India, for taking him back.

However, on the next day, the some officials realizing their mistake, allowed him to board another flight after 24 years of wait at airport with no arrangement from him to sleep or food etc.

The OP has not chosen to file reply despite of notice to it and it was proceeded exparte. We have considered the evidence of complaint, who is father of the child and appreciated his anxiety, agony and deficiency in service to his son, who too faced numerous difficulties and delay by 24 hours. Considering the unrebutted evidence, we hold OP liable of its negligence act in wrongly denying boarding to child. We award a consolidated compensation of Rs.50,000/- inclusive of litigation expenses.

 The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.

 

        Pronounced in open Court on 03.09.2015.
