ORDER

Learned advocate for the opposite party present. She submitted that opposite party is ready to pay balance amount of Rs. 8,500/- as per the settlement arrived on last date of hearing. This matter has been settled between the parties on 19.07.2010. As per the settlement the opposite party has agreed to pay Rs. 13,500/- to the complainant. As per the settlement the complainant’s son who was present before the open court received Rs. 5,000/- in cash as part payment and opposite party had taken time to pay balance payment. Therefore, time was granted for making balance payment. Today opposite party advocate present and she submitted that as per the settlement she is ready to pay Rs. 8,500/- to the complainant. But, the complainant is not present. Therefore, the matter requires to be disposed off with a direction to opposite party to pay Rs. 8,500/- to the complainant and take back the cot. The complainant is further directed to receive the amount of Rs. 8,500/- and to hand over the subject cot to the opposite party. With this direction the complaint is disposed off and matter is closed as settled amicably between the parties. Call on for compliance of the order by 12.08.2010. MEMBER MEMBER PRESIDENT
