The Misc. Application dated 19/09/203 is taken up for hearing along with its written objection.

Heard both side.

Ld. Advocate for the Decree holders/petitioners submits that the instant Commission passed judgement on 14/06/2022 in CC/192/2020 there is some typographical mistake regarding opposite party no.1.

Therefore, the same is required to be corrected.

It is further stated that following judgement passed in CC/192/2020 the same typographical mistake cropped up in Execution Application which is also required to be corrected by way of amendment.

Ld. Advocate for the Judgement debtor raised objection.

On perusal of the complaint application filed by the complainant in CC/192/2020 and the judgement passed in the case by the instant Commission on 14/06/2022. It appears that the details of opposite party no.1 has been erroneously typed in the judgement passed in CC/192/2020 which is required to be corrected for the ends of justice.

It also appears from the record of EA/78/2022 arising out of CC/192/2020 the same mistakes have been cropped up in the cause title of the Execution Application which is required to be corrected in consonance of the complaint application of CC/192/2020.

No prejudiced will be caused to the Judgement debtor, if such an inadvertent mistake done by the office of this Commission be corrected by way of amendment both in the judgement passed in CC/192/2020 dated 14/06/2022 and in the Execution Application filed in EA/78/2022 as prayed by the Decree holders/petitioners.

Therefore, the Misc. Application dated 12/09/2023 filed by the Decree holders / petitioners is allowed on contest but without cost.

The Decree holders/petitioners are directed to file amended copy of Execution Application in EA/78/2022.

Office is directed to make necessary correction with respect to opposite party no.1 in the judgement dated 14/06/2022 passed in complaint cause being CC/192/2020 immediately.
