The short fact of alleged deficiency is that the complainant had purchased four travel coupon for Rs.36,232/- valid for 6 months. The complainant used one coupon and misplaced the remaining three coupons. Several emails were exchanged between the parties and OP refused to issued the duplicate coupon. OP in its affidavit admitted that booklet conati9ng four travel coupons has been purchased by Complainant and only one has been utilized for travel. OP has refused to issue duplicate coupons on the dual grounds of misuse as well as being prohibited by terms and conditions applicable.

However, OP has not given cogent or convincing reason for refusing the issuance of duplicate coupons. The alleged terms and condition are neither elucidated nor annexed with pleadings. The OP airlines cannot justify its blatant act of not providing the service inspite of taking advance payment for said services.

  We therefore hold, OP guilty of deficiency in service and direct OP to pay Rs.27,444/- (Rs.36,232 minus Rs.8,786/-) with 9% interest from date of complaint till payment. We also award Rs.25,000/- as compensation for harassment and mental agony inclusive of litigation expenses.

The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
