ORDER
At 12:30 P.M.
Both parties called absent continuously. No other representation. It is seen from adjudication that on 19.05.2014, payment of Rs.1,29,200/- made by the Judgment Debtor. Subsequently Rs.25,000/- paid by the Judgment Debtor through cheque. In such circumstances, on 24.06.2015, it is represented by the counsel for Judgment Debtor that the entire amount pertaining to this E.A. already paid after deducting the Income Tax. On that day the Decree Holder also represented through counsel.
At the outset, it is seen that both parties didn’t turn up after 24.06.2015 i.e. nearly for past 8 months which can be presumed that the matter has been settled out of court and hence, both parties have not shown any interest in this matter. Therefore, there is no justification to proceed further.
Hence, E.A. is dismissed for default. No cost.
