The complaint is at stage of admission. Perusal of complaint reveals that insurance policy was issued from Daryaganj Branch. The Apex Court had clearly laid out in “Sonic Surgical Vs. National Insurance Co.” that jurisdiction is inferred from where cause of action has taken place. IRDA is neither the proper party nor necessary party. IRDA has been added to array of parties merely to circumvent the jurisdiction.

We therefore, dismiss the complaint with liberty to file fresh complaint in appropriate Forum.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
