        The complainant had purchased a medi claim policy from OP-2.  He was hospitalized on 19.9.09 and was discharged on 25.9.09.  He filed a claim for Rs.16,662/-.  However, Rs.1,446/- and Rs.846/- was paid by the OP-2 insurance company.  He has annexed bills with complaint.

        OP has its version has denied any deficiency.  OP has admitted sending Rs.1,446/- and Rs.886/- in lieu of medi claim without explaining the deduction. 

        Perusal of claim reveals bills for Rs.60/-, Rs.320/-, Rs.1,000, Rs.1,000/- Rs.6,360/-, Rs.65, Rs.6,331, Rs.1,404 from 23.9.09 to 21.10.09 amounting to  a sum of Rs.16,540/-.

In our considered view, OP is guilty of imperfection in service when it allowed a claim of Rs.1,446/-and Rs.886/- without explaining the deductions.  OP has failed to explain these facts in course of entire pleadings.  We hence, award Rs.10,000/- as consolidated sum to be paid by OP-2  for harassment and mental agony.  We also award a sum of Rs.5,000/- as litigation expenses.

The payment be made within 30 days of the receipt of the copy of the order; otherwise action will be taken under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.

Pronounced in open Court on 31.07.2015.
