The case is fixed today for hearing. Complainant is absent. Advocate for the OP is present. Heard from the side of the Advocate for the OP. Perused the case record along with order Dtd.10.09.2019 passed by the Hon’ble State C.D.R. Commission, Cuttack in R.P.No. 73/2019 and also Arbitration award, Chennai on Dtd.28.02.2018 in the Arbitral claim petition No.1708/2017.

         Here only the question arises on the point of maintainability of the complaint as per the order of the Hon’ble State C.D.R. Commission, Cuttack.

        On perusal of the complaint petition along with relied documents therein filed by both parties, it is found that the Arbitration Award has been passed on Dtd.28.02.2018 wherein the instant complaint has been filed before this District Form on Dtd.07.07.2018 by which it is concluded that this District Form has no jurisdiction to entertain this complaint as the matter has already been decided prior to filing of this case before this Forum hence, the complaint petition is not maintainable in this Forum. Accordingly the present C.C. is dismissed.
