The prayer made in the application is for release of the deposited amount of Rs. 1,25,000/- deposited with the State Commission by the appellant pursuant to the direction of this Commission as also a sum of Rs.35,000/- deposited in this Commission as condition precedent for filing the appeal. Since the appeal was allowed and disposed of, the appellant is entitled to refund of the deposited amount. The application is, accordingly, allowed. We direct the State Commission to refund the deposited amount of Rs.1,25,000/- alongwith interest accrued thereon, if any, as also the Registrar of this Commission to refund the amount of Rs.35,000/- deposit as pre-requisite fee.
