The Complainant is trading online in shares with OP brokers. It is alleged by him in the complaint that due to some defects in the software provided by OP, he suffered losses; mental agony etc. and also alleged that OP sold many shares without the consent. The OP has taken preliminary objection that complainant, who regularly trades in shares is not a consumer, and has cited number of judgments of National Commission, and now it is settled law that one who regularly trades in shares of various companies, through broker is not a ‘Consumer’. See judgment of Hon’ble National Commission dated 29.07.10 in the case CC/130/2010 titled Col. Balbir Singh Vs. M/s. India Infoline Ltd. & Anrs.
In view of this settled legal position, the complaint is dismissed.
