The complaint of deficiency is in relation to two travel package offers coupled with gifts on each package, by the promotional agent of OP, Book Club. The complainant religiously followed all the instructions, believing everything said as gospel truth, and failed to get the travel booking on preferred locations, and date of tour lapsed. The OP failed to respond to Notice and were proceeded epxarte.

The Exparte evidence affidavits details minor facts in details, vide Annexure 1 to Annexure 35, which are too many to be incorporated in this order, and are read as part of this order. The evidence shows that in order to promote sale of its publications, the complainant was taken for a ride. As a gullible person, he believe everything as true, and OP enjoyed the success of its trap, by getting money in the name of travel offers & gifts, failed to fulfill any promise.

We hold OP guilty of unfair trade practice by way of giving public a false promise to promote its sales. We believe the entire evidence in toto with documents and keeping in view the fact and circumstances, award a compensation of Rs.35,000/- including litigation expenses.

The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
