It is a case of deficiency on the part of IRCTC and Railways for not refunding full amount charged for journey through train no.12206 from Dehradun to Meerut on 11.05.14 paid by complainant.

Train was late for more than 5 hours so he presented TDR in IRCTC for refund of fare. Railway refunded 45% of the fare.

IRCTC in its reply has justified the deductions on the basis of a circular dated 28.12.05 by Ministry of Railways. But this circular mentions no deductions and speaks of refund of ticket amount electronically. IRCTC is misinterpreting this circular.

In case CC/687/12 titled SH.PULASTYA PRAMACHALA Vs. CHAIRMAN, RAILWAY BOARD & Ors., vide order dated 28.05.13, this Forum has examined such elaborately cases of refund and directed Railway to refund the full amount without any contest in all such cases.

Hence, holding OP2, Northern Railway, guilty of deficiency in service, we direct OP to pay balance of Rs.1,900/- along with 9% interest from date of filing TDR till payment. We also award Rs.10,000/- as compensation for harassment and litigation expenses.

The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
