The Complaint of deficiency pertain to non settlement of car theft claim of insured car by OP, despite he providing all necessary documents to the surveyor appointed by OP. The case is that complainant’s car no.DL-3CW-6394 duly insured with OP against theft from 21.09.07 to 20.09.08 was stolen on the night intervening 16-17/08/08. This was insured with IDV of Rs.3,25,000/- vide copy of cover note Annexure C1. The Complainant informed police immediately and a FIR no.584/08, was reported at P.S Dawarka. The insurance company appointed a surveyor who contacted complainant, but matter was not settled.
The OP in its reply does not dispute any fact, but alleges non-cooperation of the complainant, with surveyor. The OP in its reply has not produced any letter written to complainant from date of theft till filing of complain except a letter which is after the date of hearing fixed in April 09. The reply is sketchy.
In the given circumstances, we hold OP deficient in its services to Complainant, and direct it to settle the claim within 30 days of the receipt of this order on the basis of documents given by Complainant to OP and OP will pay Rs.30,000/- towards compensation and litigation expenses. OP will also pay interest @ 9% on this amount claimed amount from date of complaint in the Forum till payment.
The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
