The short fact of alleged deficiency is that complainant had taken insurance policy bearing No.4034/BPP/03586091/100/000 from insured of Rs.3,00,000/- for a period of one year from 17.5.2008 to 16.5.2009. The complainant was thereafter hospitalized and file medi-claim with OP, OP repudiated the claim on grounds of exclusion clause 3.2 wherein medical charges within 30 days of inception of policy was excluded OP further stated that policy holder was hospitalized on 30.5.2008 for acute pancrealise  within 30 days. 

Perusal of record reveals that complainant has neither filed any hospitalization paper nor any discharge summary though he has admitted that he was hospitalized on 30.5.2008.  Thus, the claim in his evidence affidavit squarely falls under exclusion clause 3.2 of the policy.  We, therefore find no deficiency in service on part of OP and complainant is accordingly dismissed.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
