ORDER

            We have heard learned counsel for the parties.

2.      By consent of learned counsel for the parties, the appeal is allowed on following terms:

(1)            The impugned order of the State Commission is set aside. The complaint is restored to the State Commission with direction that the same shall be decided on merits, keeping all the issues open, including the objection raised by the respondents about maintainability of the complaint.

(2)            The appellant will be at liberty to file the necessary documents including the list of market rates in respect of the quality of rice, which was sold away as alleged and in respect of alleged loss.

3.      The State Commission to expeditiously decide the complaint on merits by giving adequate reasons.  The complaint to be disposed of within a period of six months as far as possible after this order is received.

4.      The parties are directed to appear before the State Commission on 10-10-2011.  The appeal is accordingly disposed of.  No costs.
