ORDER
Member: S.R Chaudhary
The Complainant had opened a saving bank account bearing no.000701585921 with OP on 17.05.07 and OP provided a cheque book along with ATM card and he was assured by OP that account would be operative within 24 hours. Initially he had deposited Rs.5,200/- and simultaneously he had also deposited Rs.1,000/- on 19.06.07 respectively but the account was never been operative till filing the complaint.
OP admitted in his reply in Para 2 that account in question was opened as 17.05.07 with a sum of Rs.5,200/- and further deposit was sue on 19.06.07 for Rs.1,000/- over which there was no disputes by OP but OP could not activated complainant account since 2007 till filing of the complaint i.e. 22.04.09.
It appears clearly that OP could not activate complainant saving bank account despite consideration amount already received by OP bank twice. It is also noticed that complainant approached a number of times to OP bank and also met senior responsible officers who deliberately could not pay attention towards complainant grief rather they remained killing the time. Thus, OP is deficient, negligent and remained engaging with complainant’s money since 2007 to 2015. OP is directed to pay Rs.6,200/- along with interest @ 9% from date of deposit till realization. We also award Rs.10,000/- as litigation & harassment.
The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25/27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
Pronounced in open Court on 27.02.2015.
