The case of deficiency alleged against OP bank is that despite closing of current account by paying outstanding by one time settlement, bank issued statements showing debit from the fixed deposit of Rs.1 lakh for issuing on bank guarantee in favor of department of customs.
The complainant repeatedly wrote to OP from time to time about OTS, but continued receiving demands for debits raised against fix deposit. Therefore this complaint. During the pendency of complaint, after expiry of 5 years of Bank guarantee, the OP returned the FDR to complainant without any deduction.
The OP in its reply has only explained non return of FDR, earlier to 5 years as bank could be held liable by department of Customs, by discharge of Fixed Deposit, but it has not explained why debit was raised and demands from complainant from time to time despite one time settlement.
We have considered the matter and it appears to us that one department of bank was not aware of what the other department was doing sharing lack of coordination in its different branches. This has led to constant harassment to the complainant, by harassing him despite OT settlement. We hold OP guilty of deficiency and award a compensation of Rs.25,000/- to complainant for deficiency in service, harassment inclusive of litigation expenses.
The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

Copy of the order be sent to the parties free of cost.
