            The case of the complainant in short is that complainant in January, 2011 approached o.p. for treatment of his baldness and assured to be cured within six months and complainant paid Rs.8250/- by two installments and Dr. Roy, consulting physician of o.p. assured him that at least 75% growth will be there and treatment started through weekly application of rays and in take of prescribed medicines given by the clinic itself an complainant remained present in all the appointments and no fruitful result was brought forth. Hence, the case was filed by the complainant with the prayers contained in the petition of complaint.

                O.p. did not contest the case by filing w/v and matter was heard ex parte as against o.p.

Decision with reasons:

                We have gone through the evidence of the complainant and documents in particular and we find o.p. had sufficient deficiency in service being service provider to its consumer / complainant and complainant is entitled to relief.

                Hence, ordered,

                That the case is allowed ex parte against the o.p. with cost. O.p. is directed to refund a sum of Rs.8250/- (Rupees eight thousand two hundred fifty) only to the complainant and is further directed to pay compensation of Rs.7000/- (Rupees seven thousand) only for harassment and mental agony and litigation cost of Rs.5000/- (Rupees five thousand) only within 45 days from the date of communication of this order, i.d. an interest @ 10% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.

                Supply certified copy of this order to the parties free of cost.
