The short complaint of deficiency alleged against OP1 to 3; which are branches of HDFC Bank are that they together failed to inform OP4 Bank where complainant wanted to open a Duty Draw bank account in connection with his business of import and exports. It is alleged that since OP1 to OP3 did not give the introduction information to OP4 bank; the account could not be operated.

The OP1 has taken objection that he is not “Consumer” being involved in business and seeking duty draw bank account for business purpose and has on merits stated that OP1 gave an introductory letter to OP4 sharing that complainant had an account with it and OP2 but that is only role played by them and OP4 did not seek any further information. OP4 has stated that there is no cause of action, as complainant could not provide introduction for opening of account and complainant never wanted to withdraw the deposit of Rs.10,000/- for opening account.

We have considered the rival case, and find that whole complaint is in respective of commercial transaction, for commercial gains and OP4 is not located in jurisdiction of this Court, nor any cause of action has arises here in Delhi. The confirmation between the banks is their internal business and no deficiency is apparent on the part of OPs. The complaint is dismissed as complainant is not a “Consumer” with CP Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
