Respondent was not served. Counsel for the Petitioner was directed to file fresh address of the Respondent. Fresh address was not furnished. Counsel for the Appellant did not appear on 24.05.2012 and hence the present FA was dismissed for non-prosecution as well as for non-compliance of the order to furnish the fresh address. Counsel for the Appellant states that he has already furnished the fresh address of the Respondent. For the reasons stated in the application we recall our order dated 24.05.2012 dismissing the First Appeal for non-prosecution subject to payment of Rs. 2,500/- as costs. Office is directed to issue notice to the Respondent on the new address furnished by the Appellant for 04.10.2012.
