This case is put up today for exparte hearing. Neither the complainant nor his Advocate found present on repeated calls and also not  filed any steps to adjourn the case. The complainant failed to perform his obligatory duty to remain present at the time of hearing as required under Rule 4 Sub Rule 8 of the Odisha Consumer Protection Rules, 1987. 

In this case O.P. stood exparte on dated 04.05.2016 and the complainant was directed to file written argument and ready for exparte hearing. On 07.06.2016and 18.07.2016 neither the advocate for complainant nor the complainant was found present before this hon’ble court. On 08.08.2016 the advocate present before this Hon’ble court to failed to file written argument. On Dated 14.09.16 and 19.10.2016 neither the advocate for complainant nor the complainant was found present before this hon’ble court to perform his obligatory duty. Though 6 months elapsed the O.P. set exparte, complainants failed to file written argument.

            In the result we dismissed the complaint for default of appearance.

            The order is pronounced on this day of 19^th October 2016 under the signature and seal of this Forum. Copy of the order be supplied to the party free of cost.
