            The complainants filed this case against the o.p with the allegation that the complainants to avail the service of the o.p. requisitioned the cars from the o.p.. During the journey the complainants noticed that there was manipulation in the meter and the charge claimed by the o.p. was much higher than that of the contractual rate. The complainants after availing of the service of the o.p. raised his objection and asked for refund of the excess amount of Rs. 5,655/-. The complainants while found that no action was taken on the part of the o.p., a lawyer’s notice was sent. After receiving the said letter the o.p. agreed to pay Rs.20,000/- including excess amount received by the o.p.to the tune of Rs.5,655/- plus the compensation of the rest amount towards the loss suffered by the complainants.

            On perusal of the record we find that the o.p. already expressed their desire to refund the money as well as the compensation which we think reasonable since the complainant by filing this case wanted to have more compensation than that of the actual loss suffered by them. Therefore we hold that the case filed by the complainants is only for the purpose of getting excess amount nothing else as such we hold that there is no substantive ground to issue notice against the o.p.

            Accordingly the case filed by the complainants has got no merit and the same is dismissed in limini.
