O R D E R
The brief facts as alleged in the complaint are that the complainant was doing the job with the OP on the Post of Sales Manager posted at Gurugram Branch i.e. with OP-2. It is alleged that he was covered under the health Cover Mediclaim Policy for a sum of Rs.2 lacs and Group Life with critical illness for a sum of Rs.7.5 lacs. It is further alleged that for the treatment of heart valve surgery he was admitted in the Hospital on 24/04/2017 operated on 26/4/2017 and discharged on 1/7/2017. It is submitted that although he was covered under the critical Group Life critical illness policy for a sum of Rs.7.5 lacs but the OP approved his claim only to tune of Rs.1.5 lacs out of total bill of Rs.3,47,2000/-. It is further alleged that despite repeated request and reminder, OP failed to reimburse the balance claim, hence this claim.
2. Argument on the admissibility of the complaint on the point of territorial jurisdiction heard. It is stated on behalf of complainant that one of the office of OP falls within the Territorial Jurisdiction of this Forum, hence this Forum has Territorial Jurisdiction to entertain and adjudicate the present complaint.
3. We have gone through the complaint as well as documents annexed with it. During the course of argument, it is stated by the complainant that the alleged policy in question was issued by his employers for the benefit of the employee. The complainant was holding the post of Sales Manager with the Gurugram Branch of OP Co. It is stated by him that the policy was not in his possession and is with his employer i.e. OP.2 being the Group Insurance Policy. In the absence of any policy documents we are inclined to hold that the policy was issued from OP-2 i.e. from the Gurugram office of the OP. Since, neither the policy was issued from the office of the OP falling within the Territorial jurisdiction of this Forum nor the cause of action if any arose within the Territorial Jurisdiction of this Forum. We hold that this District Forum has no jurisdiction to entertain and adjudicate the present complaint. The complaint with documents be returned to the complainant against acknowledgement after retaining the copy for court record, for filing before an appropriate court.
This final order be sent to server (www.confonet.nic.in ). A copy of this order each be sent to both the parties free of cost by post. File be consigned to record room.
