            The Ld. Counsel for the complainant is present.

Today is fixed for hearing on the point of admissibility of this complaint.

At the time of hearing on the point of admission the Ld. Counsel for the complainant has submitted that this compliant is suffering from several defects, for which the complainant is inclined to ‘not press’ the petition of complaint and prays for liberty to file afresh after rectification o the said defects.

Accordingly the Ld. Counsel for the complainant has put endorsement as ‘not pressed’ in the front page of the petition of complaint.

We have perused the petition of complaint as well as endorsement of the Ld. Advocate for the complainant.

In our view as the complaint is suffering from several defects, prayer as made by the Ld. Advocate for the complainant is required to be allowed.

Accordingly, the petition of complaint CC/176/2021 is dismissed without being admitted as ‘not pressed’. There is no order as to costs.

As the petition of complaint is not admitted the complainant is at liberty to get return the copy of the complaint and other related documents as filed at the time of filing this complaint. For this purpose the complainant has to furnish a separate application before the appropriate authority of this Ld. Commission. The appropriate authority of this Ld. Commission is hereby directed to take immediate step so that the complainant can get return all the aforementioned without any further delay.

The complainant is also at liberty to approach before the appropriate Court/Commission for redressal of his/her dispute/grievance if not barred otherwise.

Let plain copy be given to the parties free of cost as per CPR.
