Today is fixed for hearing the petition dated 10/10/2023 filed by Jdrs.

Ld. Advocate for the Dhr is present. Ld. Advocate for the Jdrs is present. Jdrs filed W/O against the petition dated 10/10/2023.

Petition dated 10/10/2023 filed by Jdrs is registered as M.A. case no. 207/2023.

Heard both sides. Perused the petition. Jdrs prayed for direction upon the Barasat Municipality for issue of completion certificate. On perusal of record we find that Barasat Municipality was not the party of C.C. Case No. 174/2019. Present execution case has arisen relating to C.C. Case No. 174/2019.

We find that Jdrs prayed direction against a party who was not the party of C.C. case, even he is not the party of the present execution case and in this situation this court has no jurisdiction to issue such type of direction against the said party i.e. Barasat Municipality.

In view of above, the petition filed by Jdrs is considered and rejected.

M.A. case no. 207/2023 is thus disposed of.
