Present:    Sh. Sudhir Mahajan, Ld. Counsel for Complainant. Counsel for the OP.

 

        Counsel for OP, states that the complainant had sought possession of the flat from OP, and the price of flat is more than Rs.20 lakhs. In view of these two facts, it is contested that this Court has no territorial jurisdiction,

OP has pointed out that this Court made an observation to this effect in the case of Kanika Mahajan Vs. Dwarakadish Projects, on 19.05.2015 that the Forum had no pecuniary jurisdiction in that case.

A judgment of Hon’ble National Commission in support that in such case of seeking possession price of the flat will determine the pecuniary jurisdiction.

We have considered the submission of OP, and hold that all these cases filed are beyond the territorial jurisdiction of this Forum. The Complainant is given liberty to move appropriate Forum by getting or by getting it transferred to State Commission or filing it fresh. The time spent in this Forum will be given benefit u/s 14 of the Indian limitation Act 1963.

We accordingly hold the case non maintainable and dismiss it.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
