The Ld. Advocate of the complainant files Vakalatnama.

He also files an application for expunction of name of Smt. Mamata Sarkar (now dead) on the ground that legal heirs of Mamata Sarkar are already on record.

The application is registered as MA/196/2022 and the same is taken up for hearing with the consent of the Ld. Advocates on both sides.

After hearing the Ld. Advocate and perusing the petition in the light of other material on record, we see that the prayer for expunction of name of Mamata Sarkar is quite tenable in law as because her legal heirs are already on record. The application calls for action.

The prayer is allowed. The MA is thus disposed of.

The Ld. Advocate appearing for the complainant is directed to file amended complaint by 12.12.2022 expunging the name of the complainant no. 1.

Another application is filed by the Ld. Advocate of the complainant with copy to the other side seeking direction upon OP 3 for supply of the details of the legal heirs of the OP 2 (now dead).

The application is registered as MA/197/2022 and the same is taken upon for hearing with the consent of the Ld. Advocates on both sides.

After having heard, the Ld. Advocates on both sides and after perusing the application we see that the OP 2 has expired and OP 3 was related to him by business.

As such the OP 3 is directed to supply the details of the legal heirs of the OP 2 by the next date, if possible.

The Ld. Advocate of the complainant is also directed to take necessary steps for collection of the details of the legal heirs of the OP 2.

The application is thus disposed of.

12.12.2022 is fixed for filing amended complaint and for supply of details of OP 2.

Let a plain copy be given to the parties free of cost as per CPR.
