The short complainant of deficiency on the part of OP is that it forfeited the booking amount of Rs.7,50,000/- to relation to a commercial space in DLF Tower, Shivaji Place, Commercial Place costing Rs.1 crore 55 lakh 98 thousand, five hundred.  The agreement between the parties was duly executed containing terms and conditions.  The complainant failed to pay the installments as per agreed installment Plan.  The OP after repeated notices of demand cancelled the booking and for closed the booking.  On notice of the complainant, alleging unfair trade practices on part of OP, in forfeiting the booking amount, OP has filed reply relying on clause 11 of the Agreement between the parties.   This clause permits such a forfeiter on failure of terms.  After hearing the arguments and the material placed on record we find no deficiency of unfair trade practice on part of OP in acting in terms of a agreement.

 The complaint is dismissed.

of cost.
