ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

 

                                                                                                        JUDGMENT

 

            Complainants have filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;

            “Direct the opposite parties to provide the gas in regular manner to the complainants and pay Rs.80,000/- towards compensation for harassment, inconvenience, frustration and mental agony and Rs.5,000/- towards costs and other expenses”.

            The brief fact of the case is that, complainants are the permanent inhabitant of aforesaid address as well as beneficiaries/ consumers under IOCL and they are eligible to get service of Gas under “Rajiv Gandhi Gramin Vitarak” scheme sponsored by Central Ministry of Petroleum and Gas. Opposite party No.1 obtained license/ gas agency from opposite parties No.2 to 5 in the year 2013-14 for gas distribution to the beneficiaries in locality. Since from the year 2014 till date said agency has not properly acted to distribute the gas to the beneficiaries, for which most of the beneficiaries are in similar footing like us in locality and are depriving from getting gas, which is an essential commodity.   Since 21.11.2020 the complainants after repeated call to opposite party No.1 and his agents/staffs are not getting gas and it is came to the knowledge of the complainant from a reliable source that there was a quarrel among the opposite party No.1 with owner of the land on which the gas depo is existing has locked the houses of the gas depo. The complainants have sent the letters to the IOCL authorities (O.P. No.2 to 5) and also sent pleader notice but till date no action has been taken by the opposite parties to redress their grievances.

            Opposite party No.2 filed written version stating as under;

            The distributer has been serving gas services since Nov. 2020 there has been disturbances in the operation of M/s Devi Indane Gramin Vitrak due to frequent closure of godown by land owner and as a result refills delivery has got hampered. So for ensuring refill supplies to customers of M/s Devi Indane Gramin Vitrak, refills bookings are being transferred from M/s Devi Inane Gramin Vitrak to Arvind Indane and refill supplies are being ensured to customers of M/s Devi Indane Gramin Vitrak through nearest Indane distributor M/s Arvind Indane, Kujang, all customers of M/s Devi Indane Gramin Vitrak are getting regular refill supplies through nearest Indane distributor M/s Arvind Indane, Kujang.

            Both parties are long absent, we have gone through the records. It appears that complainants have filed this consumer complaint as if this Commission is adjudicating PIL matters. There is no allegation of deficiency in service for which consideration has been paid. Rather all the complainants have received gas immediately after booking the same. This Commission has no jurisdiction to entertain any personal dispute, public interest litigation dispute or disputed fact. There is no specific pleading in the plaint as regards deficiency in service or unfair trade practice by opposite parties.  As such complainants are not able to make out a case and accordingly consumer complaint is dismissed. No cost.
