ORDER

20/02/15

HON’BLE JUSTICE MR. KALIDAS MUKHERJEE, PRESIDENT

This Transfer Application has been filed by the Complainant stating that he filed the complaint before the Learned District Forum, Kolkata, Unit-I being case no.CDF 569 of 2014.  It has been stated in the petition that the Complainant has certain reservations against Kolkata, Unit-I and, as such, does not want to proceed with the case before the said Forum.  It has been stated further that the said Forum is disposing of the materials at the very early stage and if the case is admitted the case remains pending for about 2 years although the case should be disposed of within 90 days as per the statute.  Notice was served upon the OPs, but none appeared.

The Learned Counsel for the Complainant/Applicant has submitted that the case may be transferred to any other District Forum in Kolkata or Howrah.

Having heard the Learned Counsel for the Complainant/Applicant, we are of the view that the ground seeking the transfer of the case as mentioned in the petition cannot be said to be a sufficient ground for the transfer of a case from one Forum to another.  There is no merit in this application.

The Transfer Application bearing no.4 of 2014 is dismissed.
