Final Order / Judgement

Order No.04

Today is fixed for hearing of the application for recall of warrant.

The Ld. Advocate of the Jdrs and the Ld. Advocate of the Dhr are present. One miscellaneous application is filed on behalf of the Dhr for execution and registration of sale deed in respect to the flat in question by appointing a Pleader Commissioner. The application is registered as MA no. 146/2022 The Ld. Advocates appearing for the Jdrs concedes to such prayer and therefore the application stands allowed.

Ms. Naznin Begum, Ld. Advocate is appointed as a Pleader Commissioner for execution and registration of sale deed in respect to the flat in question. She will get a consolidated fees of Rs. 7,000/- payable by the Dhr. The Ld. Advocate appearing for the Dhr is directed to supply a copy of judgment, draft deed to the aforesaid Pleader Commissioner within 15 days hence. The Ld. Advocate of the Dhr will also ensure payment of Rs. 7,000/- within the aforesaid 15 days.

The Pleader Commissioner is directed to get a sale deed executed and registered after observing all the formalities and will file a report in compliance together with a copy of IGR by the next date.

The Ld. Advocate of the Jdrs being no. 2-4 prays for time to comply with the order for payment of Rs. 3, 30,000/- with interest @ 11% p.a. as mentioned in the concluding part of the judgment put into execution. The Ld. Advocate appearing for the Dhr agrees to accept 50% of the amount by the next date i.e. 11.11.2022.

As such, 11.11.2022 is fixed for payment of Rs. 1, 60,000/-.

The warrant issued against the OPs will remain stayed till 11.11.2022.

Send a copy of the order to the O.C. of the concerned P.S.

Inform the Pleader Commissioner.

The miscellaneous application being no. 146/2022 is thus disposed of.

The miscellaneous application being no. 132/2022 will come up for hearing on the next date.
