ORDER

By consent of learned counsel for the parties, all the above petitions are being disposed of on following terms: i) The impugned order of the State Commission stands set aside and all the matters are remitted to the State Commission with direction to restore the appeals to the original positions. ii) The State Commission shall appreciate the evidence placed on record before the District Forum and shall have afresh look to the question of limitation as well as other questions involved in the appeals. iii) The first Appellate Court observed that despite of specific objections being raised, no finding was returned by the District Forum as regards the question of limitation. Now, such a finding can be rendered by the State Commission having regard to all the relevant aspects of the matter. iv) The parties to appear before the State Commission on 31.10.2011 and afresh notices to them shall not be necessary since the Counsel for the parties undertake to inform their respective clients about the date of hearing before the State Commission. The State Commission to expeditiously hear the appeals afresh keeping all the questions open for the purpose of decision. The petitions are accordingly disposed of. No costs.
