           This case is coming on today before this Forum in the presence of  Sri Appana Venkateswara Rao, Advocate for the complainant and the opposite parties 1 & 2 having been set ex parte and Sri M. Sambasiva Rao, Advocate for the 3rd opposite party, this Forum made the following:-

 

ORDER

 

(Per Smt. H.V. Ramana, President (FAC))

 

This is a complaint filed by the complainant under Section 12 of the consumer Protection Act 1986 to direct the opposite parties jointly and severally to replace the defective vehicle with brand new one without any defects or alternatively to refund the invoice amount of Rs.27,435/- with interest at 18% p.a. from the date of purchase till payment; pay Rs.50,000/- towards damages for mental agony and pay Rs.5,000/- towards costs of the complaint.

2.         Complainant filed memo stating that the 1st opposite party replaced the TVS vehicle in place of defective vehicle and matter settled out of the Forum. Hence, the complaint is dismissed without costs.
