Present : Present OP. None for Complainant.

Argument heard.

 

The complainant has filed a complaint against OP regarding PF, Pension gratuity of her husband, Mr. Surendra Nath Mishra to be released by OP.  OP has placed on record, a civil suit filed by one Ms. Sudha Mishra in the court of senior civil judge, Azamgarh vide 449/12.  The petitioner in the said suit has stated that she is a wife of Mr. Surinder Nath Mishra and filed a suit for succession.  Complainant is one of the defendants in the suit in question.

OP railway has stated that they are bound by decision of said Court regarding succession and pension, gratuity will be released pending outcome of suit.

It is apparent that dispute is of civil nature and need to be adjudicated in civil court.  Hence, the complaint is dismissed on this ground.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
