ORDER
After reading the advertisements issued by OP No. 1 in various newspapers complainant on 03.12.2010 telephonically conducted OP-3 to purchase a laptop computer. The OP no. 3 disclosed the rate of laptop as Rs. 30,200/- with all the softwares required by the complainant. The complainant the laptop was delivered to the complainant at his office in Patiala House Courts by OP no. 3 to the complainant who paid Rs. 30,200/- in cash (receipt in annexed). On 15.02.2011 the computer in question did not work and has stated by complainant (got dead). The complainant made a telephonic call to OP No.2 who told that complaint will be attended within 3 or 4 days. The engineer of the Op did not visit the office of the complainant on 20.02.2011 and hence complainant himself visit office of the OP No.2 for removal of the defect in the laptop.
On his visit to Office of OP-2 their officials were discourteous and ill mannered behavior without checking the laptop they ask the complainant to bring certain accessories that is optical drive, XP license drive CD for window. The officials of the OP-2 refuse to issue the job card to the complainant and flatly refused to repair the laptop in question. Thereafter, complainant served a legal notice to the OP through his counsel but in vain ( Annexure C-2), hence this complaint.
On hearing the complaint, the complainant issued a notice to the OP. On 06.05.2014 the learned predecessor Bench of this Forum proceeded the OP’s ex-parte.
The complainant failed its affidavit in evidence and the rejoinder. The complainant was heard through his AR and the Forum has perused the record. The retail invoice of the laptop in question is placed on record in which book no, serial no., date along with service tax no. are given. For a somehow Rs. 30,200/-, hence this receipt remains undisputed.
The evidence of the complainant remained unrebutted and unchallenged as no written statement as no defense was taken by the OP in this case.
Keeping in view of facts and circumstances, the considered view of the Forum there is a clear deficiency on the part of the OP. Accordingly, following direction is as under:-
Copy of the order may be forwarded to the parties to the case free of cost as statutorily required.
