Learned counsel for opposite party No. 2 points out that he was never directed to file written statement within 30 days.  The case was admitted on 13.3.2013.  Notice was sent to opposite party No. 2.  No direction was given to opposite party No. 2 to file the written statement within 30 days.  However, the right was forfeited to file the written statement vide order dated 16.7.2013 assuming that such direction was given to opposite party No. 2.  As a matter of fact, no such direction was given.  Consequently, we review the order dated 16.7.2013.  The  opposite party No. 2 had already filed the written statement on 30.5.2013.  That will be read in evidence.  The order forfeiting the right to file the written statement stands reviewed and the opposite party No. 2 is directed to join the proceedings as such. 

          The case is now fixed for rejoinder of both the parties and complainant’s evidence on 15.10.2014.
