The Complainant alleges deficiency in the medicine ‘Tugan’ prepared & manufactured by OP1 for hair loss treatment. It is alleged that this medicine was prescribed by doctors of Lok Nayak Hospital. On doctor’s prescription she purchased ‘Tugan 2% and 5% from a chemist OP2. It is alleged that the medicine caused allergy & reaction for which anti-dote was prescribed. She sent the medicine to Company through its agent, but Company thereafter did not respond despite RTI application. Therefore this complaint.

The OP Company states that medicine Tugan 2% is for use of Man only and as directed by physician. It is not for use of woman. It is stated that RTI does not apply to the Company. That Complainant has to blame her doctor and not Company. We have tried to persuade company for settlement which failed.

We have considered the matter is totality. In our considered view, OP cannot be blamed for sale of medicine as prescribed by doctor. The wrong prescription is, if any by doctor, and no deficiency on the part of OP’s is made out, not withholding the finding of research papers, placed on record by complainant, which should be read by doctors.

In the circumstance, we dismissed the complaint.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
