The case record is posted today for hearing on interim petition on contest & main hearing. Neither the Complainant nor his Advocate remain present to take part in the hearing. The Advocate for O.P is present and files hazira. On perusal of the case record, it is found that on 15.11.2022, the Advocate for O.P filed a memo that the case will be dismissed against the O.P, as both the Complainant and his Advocate did not take part in hearing since long. Thereafter, notice was issued to the Complainant for his appearance, but the summon requisites returned as per postal remarks “Absent, returned to sender”. Further, since 13.01.2022 to till today, the Complainant remained absent and also no step on his behalf was taken. From the above nature and conduct of the Complainant, it is clearly made out that sufficient opportunities have been given to the Complainant for hearing of this case, but the Complainant has no interest to proceed with this case further. In the above facts and circumstances of the case, this Commission is of the view that the complaint of the Complainant should be dismissed.

                                         Accordingly, the case of the Complainant is dismissed for default.
